payment free promotion: official rules

No Purchase Necessary.

1.   Eligibility: The Columbia Credit Union (“Columbia”) Payment Free Promotion (the “Promotion”) is open and offered only to legal residents of the States of Washington and Oregon age 18 or older as of June 1, 2009 and who have satisfied the eligibility requirements.  Employees, officers and directors of Columbia (“Sponsor”), or their parents, affiliated and subsidiary companies; their legal advisors, advertising and promotional agencies, and web suppliers for this promotion; as well as the immediate family (spouse, parents, siblings and children, regardless of where they live) or members of the households of such employees, officers or directors (whether or not related), are not eligible.  By entering, you agree to these Official Rules and the decisions of Sponsor, which are final and binding in all respects.  Void where prohibited.

Member Eligibility:  Member must open and fund a qualifying Columbia consumer loan or 1st Mortgage during the promotional period and be enrolled to make automatic payment from a consumer Columbia checking account.  At the end of the Promotional Period, the first person listed on the Columbia checking account with a positive balance and who also enrolled in automatic payments to a Qualifying Loan is automatically entered. If the Columbia checking account funding the Qualifying Loan of the Winner is closed by an accountholder, or by the Credit Union for not meeting legal and internal requirements, prior to December 5, 2010, Prize deposits will also end at that time.  If automatic payment to Qualifying Loan from funding checking account ceases prior to December 5, 2010, prize deposits will end. Business accounts trust accounts and minor accounts are not eligible for this promotion.

Qualifying Loan:  Qualifying Loans are opened during the Promotional Period with balances of at least $10,000 for a) 1st Mortgages for primary residence, second residence or construction of new home. 1st Mortgage can be used to purchase, refinance from elsewhere or, refinance Columbia Credit Union 1st mortgage when refinance includes $10,000 or more cash-out, not used to pay off other Columbia Credit Union loans b) a new or refinance from elsewhere home equity line-of-credit or home equity loan and c) the purchase or refinance from elsewhere of a vehicle (“Qualifying Loan”). Qualifying Loan must be in agreement with all loan terms and conditions and may not be more than 30 days delinquent at the time of the drawing.

2.   Promotional Period: Promotion begins on June 1, 2009 at 12:01:00 p.m. Pacific Time (“PT”) and ends on November 30, 2009 at 11:59 p.m. (PT) (the “Promotional Period”).

3.   Prize/Odds:  One (1) person will receive a Prize of 1st Mortgage Payments for a Year: maximum value of $14,400. One (1) person will receive a Prize of Home Equity Payments for a Year: maximum value of $6,000 and one (1) person will receive a Prize of Auto Loan Payments for a Year: maximum value of $4,200. The winner(s) taking possession of the Prize(s) is solely responsible for taxes. Prize may not be substituted, transferred or exchanged. There are no other prizes. Odds of winning depend on the number of eligible entries received.  If a winner cannot accept the prize as stated, prize will be forfeited and awarded to an alternate winner. Prize will be awarded as follows:  1st Mortgage Payments for a Year:  On the 5th of each month, a deposit of $1,200 or principal and interest due on the 1st mortgage (whichever is less) will be deposited into the winner’s checking account from which automatic loan payments to the 1st mortgage are made. If Winners 1st Mortgage is sold during the promotional period or during 2010, the principle and interest payment established at original loan funding (up to the maximum of $1,200) will be deposited into the winner’s checking account originally designated to automatically make mortgage payments. Prize award will cease on December 5, 2010 or when the automatic payment from funding checking ends, whichever comes first. Otherwise, Prize award deposits will start January 5, 2010 and will continue until the loan is paid off, the funding checking account is flagged closed, or until December 5, 2010, whichever comes first. Home Equity Line/Loan Payments for a Year:  On the 5th of each month, a deposit of $500 or principal and interest due on the equity loan or line-of-credit (whichever is less) will be deposited into the winner’s checking account designated to make automatic payments. Deposits will start January 5, 2010 and will continue until the line or loan is closed, the automatic payment from funding checking ends, or until December 5, 2010, whichever comes first. Vehicle Loan Payments for a Year:  On the 5th of each month, a deposit of $350 or principal and interest due on the vehicle loan (whichever is less) will be deposited into the winner’s checking account designated to make automatic payments. Deposits will start January 5, 2010 and will continue until the loan is paid off, the automatic payment from funding checking ends, or until December 5, 2010, whichever comes first. Winning mail-in entries will be awarded the Prize maximum value by certified mail no later than January 31, 2010.

4.   Entry:  Eligible Members will receive one (1) automatic entry for each Qualifying Loan. Alternatively, if unable to qualify for automatic entry, individuals may submit a maximum of one (1) mail-in entry for each Prize by mailing a 3x5 postcard which Columbia Credit Union must receive by November 30, 2009. Eligible mail-in entries cannot be delinquent on any Columbia Credit Union loan, owe Columbia money for overdrawn accounts, past-due fees, charge-off accounts, fraud or any other derogatory obligation at the time of the drawing or in the past. Mail-in entries must legibly designate entrant’s name, address, phone, email address and Prize. One Prize per postcard. Postcards that do not meet these requirements will be considered invalid. Mail 3x5 postcard to: Columbia Credit Union (“Columbia”) “Payment Free Loan Promotion”, c/o Marketing Department, PO Box 324, Vancouver, WA 98666-0324. Entrants may not enter with multiple identities nor may entrants use any other device or artifice to obtain more than the maximum number of entries. Any entrant who attempts to participate with multiple identities or uses any device or artifice to obtain more than the maximum number of entries may be disqualified.

5.   Drawing:  Three separate drawings will take place for the three Prizes. For each Prize, all eligible entrants will be assigned a unique identifying number and placed into a database from which a winner will be randomly selected.  Winner must agree to all conditions in these Rules, otherwise subsequent drawing(s) will occur until a Winner accepts. Drawings will occur by December 14, 2009. Winner will be notified by phone, email, or letter and must accept the Prize including executing any documents described in Section 6 of these Rules by December 18, 2009. 

6.   General Conditions:  Winner must be able to verify he/she was 18 years of age as of June 1, 2009. Winner may be asked to complete, execute and return an Affidavit of Eligibility, a Liability Release, and where lawful, a Publicity Release prior to taking possession of the Prize.  Failure to sign documents, or if prize notification is returned as non-deliverable, or if winner is found to be ineligible or not in compliance with these official rules, then disqualification will result and an alternate winner will be selected.  By accepting prize, where permitted by law, winner grants to Sponsor and those acting pursuant to Sponsor’s authority (and agrees to confirm said grant in writing) the right to use and publish his/her name, biographical information, statements made regarding the Sponsor, or the Promotion (provided same are true), portrait, picture, voice and likeness for trade, advertising and promotional purposes without additional consideration, or notification, review or approval, worldwide, and on the Internet. By participating, entrants release and agree to hold harmless Sponsor and its parents, affiliates, and subsidiary companies, advertising and promotion agencies and their respective directors, officers, employees, representatives and agents from any and all liability for any injury, loss or damage of any kind to person, including death, and property arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of the prize, participation in any Promotion related activity, or participation in this Promotion.

7.   Limitations of Liability: Sponsor is not responsible for any incorrect or inaccurate information, whether caused by website users, or by any of the equipment or programming associated with or utilized in the Promotion and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or tampering with or hacking of, the web site or any technical failure of malfunction.  Sponsor is not responsible for injury or damage to participants’ or to any other person’s computer related to or resulting from participating in this Promotion or downloading or copying materials from or use of the website.  If, for any reason, the Promotion is not capable of running as planned by reason of infection by computer virus, bugs, worms, tampering, hacking, unauthorized intervention, fraud, technical failures, or any other causes which, in the sole opinion of Sponsor, corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, Sponsor reserves the right at their sole discretion to cancel, terminate, modify or suspend the Promotion, and select the winner from entries received prior to the action taken, or as otherwise deemed fair and equitable by Sponsor. IN NO EVENT WILL SPONSOR, THEIR PARENTS, AFFILIATES, SUBSIDIARIES AND RELATED COMPANIES, THEIR ADVERTISING OR PROMOTION AGENCIES OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF SPONSOR’S INTERNET SITES OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SAID SITES.  WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THESE SITES IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.  SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OR LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.  CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.

8.   Arbitration/Choice of Law: Except where prohibited by law, entrants agree that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Promotion, or any prize awarded, or the determination of the winner shall be resolved individually, without resort to any form of class action, and exclusively by arbitration pursuant to the Rules of the American Arbitration Association then effective; and (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and/or Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Washington, without regard for conflicts of law doctrine, and all proceedings shall take place in Vancouver, WA.
